D.C. Law 24-15. Interim Term of the State Superintendent of Education Temporary Amendment Act of 2021.
AN ACT
To waive, on a temporary basis, certain requirements in the Confirmation Act of 1978 to extend the period of time during which the person serving in an interim capacity as the State Superintendent of Education may be compensated; and to waive the District residency requirements in the Jobs for D.C. Residents Amendment Act of 2007 and the District of Columbia Government Comprehensive Merit Personnel Act of 1978 to permit the person serving in an interim capacity as the State Superintendent of Education to be a non-District resident.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Interim Term of the State Superintendent of Education Temporary Amendment Act of 2021".
Sec. 2. Section 2(a)(1) of the Confirmation Act of 1978, effective March 3, 1979 (D.C. Law 2-142; D.C. Official Code § 1-523.01(a)(1)), shall not apply to the compensation of a person serving in an interim capacity as the State Superintendent of Education from April 6, 2021 through December 31, 2021.
Sec. 3. Section 103 of the Jobs for D.
C. Residents Amendment Act of 2007, effective May 23, 2019 (D.C. Law 22-315; D.C. Official Code § 1-515.03), shall not apply to the residency of a person serving in an interim capacity as the State Superintendent of Education from April 6, 2021 through December 31, 2021.
Sec. 4. Section 906(a) of The District of Columbia Government Comprehensive Merit Personnel Act of 1978, effective March 3, 1979 (D.C. Law 2-139; D.C. Official Code § 1-609.06(a)), shall not apply to the residency of a person serving in an interim capacity as the State Superintendent of Education from April 6, 2021 through December 31, 2021.
Sec. 5. Fiscal impact statement.
The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).
Sec. 6. Effective date.
(a) This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), a 30-day period of congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of Columbia Register.
(b) This act shall expire after 225 days of its having taken effect.
