D.C. Act 24-347. Advisory Neighborhood Commission Redistricting Deadline Extension Emergency Amendment Act of 2022.
AN ACT
To amend, on an emergency basis, the Redistricting Procedure Act of 1981 to extend the deadline for submission of ward task force reports on the redistricting of Advisory Neighborhood Commission areas and single-member districts; the Advisory Neighborhood Commissions Act of 1975 to extend the deadlines for the Council to enact legislation adjusting boundaries and for the Board of Elections to make available nominating petitions to candidates; and the District of Columbia Election Code of 1955 to authorize the Board of Elections to draw precinct lines for the November 2022 general election without Council approval.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Advisory Neighborhood Commission Redistricting Deadline Extension Emergency Amendment Act of 2022".
Sec. 2. Section 3(a)(1) of the Redistricting Procedure Act of 1981, effective March 16, 1982 (D.C. Law 4-87; D.C. Official Code § 1-1041.02(a)(1)) is amended by striking the number "90" and inserting the number "95" in its place.
Sec. 3. The Advisory Neighborhood Commissions Act of 1975, effective October 10, 1975 (D.C. Law 1-21; D.C. Official Code § 1-309.01 et seq.), is amended as follows:
(a) Section 4(b) (D.C. Official Code § 1-309.03(b)) is amended by striking the phrase "made less than 180 days" and inserting the phrase "made by the Council less than 154 days" in its place.
(b) Section 6(b)(2) (D.C. Official Code § 1-309.05(b)(2)) is amended by striking the phrase "120th calendar day" and inserting the phrase "111th calendar day" in its place.
Sec. 4. Section 5(a)(8) of the District of Columbia Election Code of 1955, approved August 12, 1955 (69 Stat. 700; D.C. Official Code § 1-1001.05(a)(8)), is amended by striking the phrase ", subject to the approval of the Council, in whole or in part, by resolution." and inserting a period in its place.
Sec. 5. Fiscal impact statement.
The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).
Sec. 6. Effective date.
This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 90 days, as provided for emergency acts of the Council of the District of Columbia in section 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; D.C. Official Code § 1-204.12(a)).
