D.C. Law 25-61. Law Enforcement Arrest Authority Technical Correction Temporary Amendment Act of 2023.

AN ACT

To amend, on a temporary basis, section 23-581(a)(3) of the District of Columbia Official Code to make a technical correction to clarify that a law enforcement officer may arrest, without a warrant having been previously issued, a person that the officer has probable cause to believe has committed the offense of fleeing from the scene of an accident, if the officer has reasonable grounds to believe that, unless the person is immediately arrested, reliable evidence of alcohol or drug use may become unavailable or the person may cause personally injury or property damage.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Law Enforcement Arrest Authority Technical Correction Temporary Amendment Act of 2023".

Sec. 2. Section 23-581(a)(3) of the District of Columbia Official Code is amended as follows:

(1) Strike the phrase "Fleeing from the scene of an accident" and insert the phrase "Leaving after colliding" in its place.

(2) Strike the phrase "section 10(a) (D.C. Official Code § 50-2201.05(a))" and insert the phrase "section 10c (D.C. Official Code § 50-2201.05c)" in its place.

Sec. 3. Fiscal impact statement.

The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

Sec. 4. Effective date.

(a) This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), a 60-day period of congressional review as provided in section 602(c)(2) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813, D.C. Official Code § 1-206.02(c)(2)), and publication in the District of Columbia Register.

(b) This act shall expire after 225 days of its having taken effect.

After mayoral review, it was assigned Act No. 25-156 on July 10, 2023, and transmitted to Congress for its review. D.C. Law 25-61 became effective Oct. 5, 2023.
