D.C. Law 25-160. Litter Control Amendment Act of 2024.

AN ACT

To amend the Litter Control Administration Act of 1985 to clarify that residential premises may be inspected and investigated for an alleged nuisance, and to authorize the service of a notice of violation by first-class mail to a person alleged to have created a nuisance or to the owner of the premises.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Litter Control Amendment Act of 2024".

Sec. 2. Section 4 of the Litter Control Administration Act of 1985, effective March 25, 1986 (D.C. Law 6-100; D.C. Official Code § 8-803), is amended as follows:

(a) Subsection (b) is amended as follows:

(1) Strike the phrase "enter a nonresidential premises" and insert the phrase "enter a residential or nonresidential premises" in its place.

(2) Strike the phrase "a nuisance." and insert the phrase "a nuisance; provided, that an inspection or investigation at a residential premises may only occur in common areas at the premises." in its place.

(b) Subsection (c)(2) is amended as follows:

(1) Strike the phrase "certified mail" and insert the phrase "certified mail or first-class mail" in its place.

(2) A new sentence is added at the end to read as follows:

"When service is by first-class mail, 5 additional days shall be added to the time period within which the owner of the premises or person responsible for the nuisance may, or is required to, take any action specified in the notice.".

Sec. 3. Fiscal impact statement.

The Council adopts the fiscal impact statement in the committee report as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

Sec. 4. Effective date.

This act shall take effect after approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto) and a 30-day period of congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)).

Law 25-160, the “Litter Control Amendment Act of 2024,” was introduced in the Council and assigned Bill No. 25-412 which was referred to the Public Works and Operations. The bill was adopted on first and second readings on Jan. 9, 2024, and Feb. 6, 2024, respectively. After mayoral review, it was assigned Act No. 25-409 on Mar. 1, 2024, and transmitted to Congress for its review. D.C. Law 25-160 became effective Apr. 20, 2024.
