D.C. Law 24-302. School Psychologist Licensing Clarification Amendment Act of 2022.

AN ACT

To amend the District of Columbia Health Occupations Revision Act of 1985 to clarify that a school psychologist employed by the District of Columbia Public Schools or a public charter school and working in accordance with regulations issued by the Office of the State Superintendent of Education is excluded from the Board of Psychology's regulation of the practice of psychology; to amend the Perinatal Mental Health Task Force Establishment Act of 2022 to remove the requirement that the Council confirm each appointee and to extend the deadline for the submission of the final report; and to make other conforming amendments.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "School Psychologist Licensing Clarification Amendment Act of 2022".

Sec. 2. Section 102(16)(B) of the District of Columbia Health Occupations Revision Act of 1985, effective March 25, 1986 (D.C. Law 6-99; D.C. Official Code § 3-1201.02(16)(B)), is amended as follows:

(a) Sub-subparagraph (i) is amended by striking the period and inserting the phrase "; or" in its place.

(b) Sub-subparagraph (ii) is amended to read as follows:

"(ii) A school psychologist employed by District of Columbia Public Schools or a public charter school and working in accordance with regulations issued by the Office of the State Superintendent of Education.".

Sec. 3. Section 5043 of the Perinatal Mental Health Task Force Establishment Act of 2022, effective September 21, 2022 (D.C. Law 24-167; D.C. Official Code § 7-1234.02), is amended as follows:

(a) Subsection (b) is amended by striking the phrase "By August 31, 2023," and inserting the phrase "By October 1, 2023," in its place.

(b) The lead-in language of subsection (c)(7) is amended to read as follows:

"(7) The following members appointed by the Director of the Department of Health Care Finance:".

Sec. 4. Section 2(f)(71) of the Confirmation Act of 1978, effective March 3, 1979 (D.C. Law 2-142; D.C. Official Code § 1-523.01(f)(71)), is repealed.

Sec. 5. Fiscal impact statement.

The Council adopts the fiscal impact statement in the committee report as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

Sec. 6. Effective date.

This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), a 30-day period of congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of Columbia Register.

Law 24-302, the “School Psychologist Licensing Clarification Amendment Act of 2022,” was introduced in the Council and assigned Bill No. 24-648 which was referred to the Health. The bill was adopted on first and second readings on Dec. 6, 2022, and Dec. 20, 2022, respectively. After mayoral review, it was assigned Act No. 24-734 on Jan. 10, 2023, and transmitted to Congress for its review. D.C. Law 24-302 became effective Mar. 10, 2023.
