§ 50–2352.06. Civil penalties and other sanctions.

(a)(1) A person or entity that violates this chapter, or a regulation promulgated pursuant to this chapter, shall be subject to a civil penalty of not more than $1,000 per offense.

(2) Each day of a violation of this chapter, or a regulation promulgated pursuant to this chapter, shall constitute a separate offense, and the penalties set forth in this subsection shall be applicable to each separate offense.

(b) In addition to, or in lieu of, the civil penalty described in subsection (a) of this section, the Department may modify, suspend, revoke, or deny an AV testing permit issued by the Department for a violation of this chapter, or a regulation promulgated pursuant to this chapter, after notice and opportunity for a hearing pursuant to § 50-2352.07.
