D.C. Act 24-233. Advisory Neighborhood Commission Pandemic Election Procedures Extension Clarification Emergency Amendment Act of 2021.
AN ACT
To amend, on an emergency basis, the Advisory Neighborhood Commission Pandemic Election Procedures Extension Emergency Amendment Act of 2021 to clarify the role of the Office of Advisory Neighborhood Commissions in support of Advisory Neighborhood Commissions.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Advisory Neighborhood Commission Pandemic Election Procedures Extension Clarification Emergency Amendment Act of 2021".
Sec. 2. Section 2(b) of the Advisory Neighborhood Commission Pandemic Election Procedures Extension Emergency Amendment Act of 2021, effective October 20, 2021 (D.C. Act 24-179; 68 DCR 11316), is amended as follows:
(a) Amendatory sub-sub-subparagraph (I) of paragraph (2) is amended as follows:
(1) Strike the phrase ", OANC, in consultation with the Advisory Neighborhood Commission" and insert the phrase ", the affected Advisory Neighborhood Commission, in consultation with OANC" in its place.
(2) Strike the phrase "designate, or by a representative of OANC." and insert the phrase "designate, or, in the event that the Office of the Chairperson is vacant or there are no Commissioners present, by the presiding Commissioner at the next regularly scheduled meeting of the Commission; and" in its place.
(3) Strike the phrase "In the event that the office of the Chairperson is vacant, the results shall be read aloud by the Commissioner presiding over the meeting or by a representative of OANC; and".
(b) Paragraph (3)(A) is amended by striking the phrase "OANC, in consultation with the affected Advisory Neighborhood Commission" and inserting the phrase "the affected Advisory Neighborhood Commission, in consultation with the OANC" in its place.
Sec. 3. Fiscal impact statement.
The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).
Sec. 4. Effective date.
This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 90 days, as provided for emergency acts of the Council of the District of Columbia in section 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; D.C. Official Code § 1-204.12(a)).
